Why would post's to an Internet forum not be considered information readily available to the public, including the courts?

I believe the point is not that it is public record, but that someone posing as a "friend" was the one who supplied what he believed to be detrimental to another member.

If it is the case I believe it is our member was cleared (sort of). Still being appealed if I am not mistaken, it's going on three years now.
