    Cook County clerk’s office tells ABC they were shocked that no written motions were filed with the court in connection with dismissal in the Smollett case. On top of that, the case has been wiped off their database as if it never existed.

    IANAL, but I have watched a lot of Perry Mason.

    Am I incorrect in believing, that the mere dropping of a charge is not an acquittal, therefore, it would not constitute double jeopardy if the charges were refiled?

    Generally, that is correct. Different states can have different specific rules on how many times criminal charges can be filed for the same conduct, but jeopardy usually doesn't "attach" until a jury is sworn in.

    As long as he doesn't buy a sandwich, he should be good. Clearly the Subway was what alerted the Trump supporters that a gay, anti-trump activist was available and ready to be victimized.

    If charges are dropped, and it isn't an active investigation, Illinois law may allow for the complete file to be released.

    In this situation, Chicago PD has some motivation to actually release the whole thing.
    I say why the hell not. Smollett gets to strut around comfortably proclaiming he’s innocent because the case files are sealed at this time and his attorney pops off about innocent until proven guilty then evidence to rebutt that should be allowed.

    It’s been reported that the charges were dropped and the records sealed. If the police can release the evidence, exactly what was sealed?
