I've spoken to the officers/supervisors on the scene...no one suspected alcohol from ANY of the drivers. Medics checked Dave at the scene and NADA. He went to Methodist Occupational Health (med check) to treat minor injury from the crash, that is where all city employees go for minor things. While there, a doctor checked him out, eyes as well, for concussion (he did not have one) and doctor gave him a clean bill of health. It was while he was at the Med Check that the FACT officer asked for blood (as an afterthought since no one suspected DUI). That is why it was done there and not at Wishard where we always go. The technician was unfamiliar with taking blood as evidence and its not her fault for not knowing, they do not do that there. There is no cover-up, the officers on the scene (good friends of mine) are not going to risk their careers, their freedom, their kids/wives well being, to cover up a bad officer. We are talking a dozen officers, several deputy chiefs, medics, non-leo witnesses, doctor, and medical technician, who all came into contact with Dave and none of them had any inkling of alcohol. The prosecutor's office did not speak to any of them prior to the charges being filed. Dave will be held responsible for the death he caused (as he should) but all ducks should have been in a row PRIOR to charges filed. I have seen hard core functioning drunks that walk and talk OK. However, one look in their eyes and BAM, they are caught. Their nystagmus is so distinct that it looks like their eyes have palsy. Medics/doctors are good at spotting it, it is VERY obvious. He did not show any of that. I still believe there is something wrong with the first test. I could be 100% wrong but nothing adds up to that number.
