    As long as all the officers arrived safely home that night...:rolleyes:

    It would seem to me that the desire to set up a lookout or command post in a home would be done on the down-low as to not alert the target home of a police presence. To go sreamin and door kickin around the neighborhood seems counterproductive to me.:dunno:

    I think it is / took it as - the plaintiff's did not manage to get / remember the names of these specific officers.

    And I say good for the family. I hope they win and these cops get punished, I'm not anti-cop, the number of good ones far outweigh the bad ones, but if nothing happens when crap like this happen they'll just continue.

    Though of course, these cops will likely get promoted or get a paid vaca.. I mean, paid leave.

    While your thoughts are perfectly reasonable in terms of practical application, my guess is that the original purpose was dwarfed by the fact that we can't be allowing uppity serfs to tell the police to go find their own house.

    Disregarding Hawkeye, I can't fathom a defense. This appears to be residential entry, false imprisonment, battery, and a laundry list of other crimes. The hell with the 3rd Amendment, which I don't think applies, but the other charges surely.

    It has happened once in modern times.

    I will agree that, proven true, this is a major transgression of property rights. I would be willing to hear a case based on immediate public threat, and most likely agree. This case, as presented in the complaint, sounds quite bad. The time gap also brings up some questions.

    Why does this indicate anything wrong? By the time you get past dealing with the bogus charges, then waiting for the PD internal due process to take an indefinite amount of time after which it is determined that the PD is not going to self-correct in terms of discipline or restitution, and then allowing the plaintiff's lawyer(s) time to prepare, two years doesn't seem unreasonable.
