Just so you guys know that I practice what I preach.

This has been the view from my front porch for at least 2 months now. We did not call the owners until at least 2-3 weeks after they knocked this trailer down and left it. We only called because trash from it was blowing in our yard. Their property rights end at my property line. They told us they'd be out the following Saturday to clean it up. About 3 Saturdays later, they still hadn't showed up. We called again and they had excuses so we called the Board of Health. They finally cleaned up some of it a few weeks ago and here is how it still sits. It was an old house trailer that was rented out. I'd rather it sit like it does now than have the douche bags that were in it last back. I think that pile of trash right by the road has sat there for 2 years now.

And just a 90 degree turn, this sits in my front yard about 10 feet from the road. I didn't need to get anyone's permission to put it up and if anyone complains about it, I can tell them to sit and spin.

I'm not saying this applies to you, but the argument many other posters made was that if these folks had been MOH awardees, then they have the right to not clean up.

Just following their logic out to its conclusion.

I don't understand the comparison between flying our country's flag, and having trash all over your yard....

I don't like looking at the trash in that yard but it didn't infringe on my rights until I had to start picking up the stuff that blew into my yard. Surprisingly I haven't had to pick up all that much. As soon as they tore it down, I figured it would be blowing over all the time.

One could argue that it poses a hazard to any children who might try to go play in the mess and it could but the bigger argument is that it is your responsibility to keep your children off of someone elses property.

As much as I hate looking at it, my dislike doesn't outweigh the owners right to be a douche. I just hope it is cleaned up by summer as that is when I plan on putting my house up for sale.

I don't understand the comparison between flying our country's flag, and having trash all over your yard....

    I'll explain:

Principle One: Abiding by the rules of associaion and the agreements you've made voluntarily (the facts of this are not completely known and are under dispute, I understand).

Principle Two: In general, I have the right to do what I wish on my own property.

Principle Three: Flying the flag is a special circumstance that should trump certain other considerations.

Principle Four: MOH awardees should be extended priveleges not accorded to the rest of us.

All of these have been argued in this thread, separately, some together. My bone to pick from the beginning was with those who implied that a)principle 4 is a valid principle, and b) that's why the guy should be able to fly the flag.

I illustrated that with my post, then you invoked Principle Three.

    WOW

Good luck selling your house with that view! I'd think if I was you I would get your neighbors to clean that up first.

I think the problem with HOA's (and yes I've btdt, but NEVER again) is that most of the people living in them don't understand the power that they wield. There are documented cases of HOA's throwing legitimate owners out of their house for failing to obey association rules. Yeah I know, hard to believe but true, it happened in Calipornia for one and others. I did a lot of research on them while living under their jackboots.

As for MOH awardees receiving special priveleges that others don't get, I would vote for that in a heartbeat!

The HOA I lived in was a lake community, there were actually two different groups there, lakeside people and "the others". They were spending huge amounts of money to support the lake at the expense of all the other amenities were left to rot and fall down. On more than one occassion at a monthly meeting I heard the phrase, "they aren't one of us" when referring to non-waterfront owners. They ran the place by virtue of the fact that any non-waterfront owner that happened to get elected would be runoff by the other officers on short order. When the ex-wife told me she was "taking your house", well that was the second happiest day of my life. I hope she is enjoying the covenant nazis that she is stuck with.

This is great news. So maybe the tons of phones calls and general support showed for this exceptional man paid off. I'm glad to see a good guy win one. Lets hope this is the start of a trend of people standing up to be counted.

That is great news!! Though I do have to admit that a part of me also hopes that people, if they know they are moving into a HOA neighboorhood, find out what the rules are. Heck, when I bought my house I wish I knew I was getting into a HOA in the first place!

I noticed under "Tags" it said "anti-america, home owners association." I believe HOAs to be the beginning of teaching Americans how to become communists.
