Unless and until we know where the money came from - which the FEC should be able to determine - I don't think that's the path to the criminal offense.

Basically, the chambers of Congress get to decide what meets the definition of "high crimes and misdemeanors." Possibly with help from SCOTUS. (Which would bring about a textbook definition of a constitutional crisis.)
