    The jury is gonna vote based on bias.

    Pretty much, you're gonna see what I just stated. There has to be a risk to life, or "serious" bodily injury. Determined by the "average man".

    But if you say that you are afraid of people with green eyes... you might have a hard time using that defense.

    Contrary to popular belief... yelling "I'm in fear for my life" is NOT a guaranteed defense.

    perception plays a big part in juries I imagine.


    Say that you and 2 other very large bikers were deathly afraid of an 80 pound, 90 year old woman.. and the jury might find that hard to believe.

    On the other hand, maybe she's a ninja, and all 3 of you just had surgery.
