Where's the bacon?
& that bill has been signed!
Are you telling me we FINALLY lost the grey zone!!!!

Now... NOW you see why I was so excited about this!

We still have the ludicrous and spurious GFSZ and it is still a felony, there or on a school bus, but these are places that are clearly and easily identifiable, and one cannot, in the normal course of a day's activities, accidentally become a felon by means of this statute any longer. You have to go *to* a school or *board* a school bus while armed with a firearm to violate this law, as of today. We have moved one large step closer to liberty by the stroke of Gov. Pence's pen. Let's add him to the list of thank-you notes, shall we?

Blessings,
Bill

So in other words you have to go to a GFSZ while armed to become a felon. The GFSZ cannot come to you, slap on the cuffs and say 'Gotcha!"

Governor Pence: 2013 Bill Watch

Look way down the page. The Gov. received SEA 001 on 5/4/13 and signed it today, 5/7/13.

[STRIKE] And it became law the instant he signed it.[/STRIKE] CORRECTION: This becomes effective July 1, 2013. My error, and my apologies.

Correct. The switchblade ban was called "The Movie Scare".

Popular culture pushes legislation.
Same for the dreaded Chinese throwing stars. I can't remember the last mass murder that was attributed to them that brought about their prohibition.

Was there ever a real problem with malcontents yielding them for the purpose of murder and mayhem? :dunno:

Actually, I believe the reason Chinese throwing stars were banned was to crack down on the rampant problem of Chinese ninjas. This seems to be working as, to date, I have yet to encounter a Chinese ninja.

Quoted my own post, made a week ago, but necessarily kept hidden.

I have been champing at the bit to tell everyone about this, however, as hard-fought as it was, I was not going to chance a letter or call campaign to Gov. Pence not to sign it. In addition, SEA 1 had the line in it, "An emergency is declared for this act.", which means it is law *right now*!

I do want to add that things like this happened not only because of a bunch of politicians getting in a room together, but because of the drive behind them to do so, and because we are electing people who "get it", people who understand that guns are not the problem, criminals are.

My thanks to every legislator who worked to draft this and every legislator who voted to pass it.

Blessings,
Bill

My appologies, Jedi. With the pink ring in your avatar, I just assumed you were female.

Back to topic; so as of the instant the bill was signed by Pence, LTCH owners no longer have to worry if a place is being used by a school event. Only schools and busses are no-go.

Does this also apply to the use of suppressors while hunting? Or does that part of the bill wait to go into effect until July 1st?

no worries jason. you are not from Da Region so all is forgiven. :)

since the rolling school zone is gone does this also mean that if you are a participant in say a field trip to the zoo that you can carry while you go with the school (ie. accompany your child) so long as you drive/meet them at the place and not take the bus or start/end at the school property?

[STRIKE]Um… what?[/STRIKE] NM. I thought you were referring to HEA1563. I wasn't aware of SEA1.

So, if the switch blade + silencers + other natural resources schtick bill only goes into effect July 1, then that's just under 1300 hours.

No, the suppressor thing and the switchblade thing are both part of HEA 1563. This is SEA 001. (That's Senate Enrolled Act 001, now a law)

It would seem so, however, I'm going to wait for someone with a law degree to answer that. Usual disclaimers apply: IANAL, TINLA

Wait, so I just read SEA1, and noted the school resource officer line, so does that mean that only one (1) armed resource officer is required per school corporation? Or (I hope) did I misread, and each school in the district is required to have a resource officer? I really, really hope it is each school, otherwise this portion of the law is largely symbolic, a huge leap in the right direction, but still just symbolic in my eyes.

Take, for example, Monroe County Community School Corporation:
14 Elementary schools
4 Middle schools
-and-
4 (technically 5, but the HHCC is housed inside North) High schools

That is a total of 22(23) schools spread over 411 square miles... I pray that they are not thinking one (1) resource officer could even dream to cover even 1/4 of these schools.

I understand from a resource prespective having to hire 22 Resource Officers at say 50k per is a staggering amount of capitol, $1.1 million, but couldn't they open that up to volunteers? Maybe a small stipend to any faculty member that wishes to have a dual duty? I am thrilled that the legislation is taking action to keep our children safe(r) at school, but seriously 1 RO per corporation?

I think you are correct 1 RO per school corporation.

The law read:

Sec. 9. (a) Each schoolcorporation shall designate an individual to serve as the school safety specialist for the school corporation.

SOURCE:
http://www.in.gov/legislative/bills/2013/PDF/SE/SE0001.1.pdf

It's symbolic more than anything else and another "burecrate" in the system. :(

Furthermore the law got cleaned up as follows:

SECTION 12. IC 35-47-9-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 1. This chapter does not
apply to the following:
(1) A:
(A) federal;
(B) state; or
(C) local;
law enforcement officer.

(2) A person who
may legally possess a firearm and who has
been employed or authorized by:
(A) a school; or

a school board (as defined by IC 20-26-9-4);
or
(B) another person who owns or operates property being used
by a school for a school function;

the body that administers
a charter school established under IC 20-24;
to act as a security guard, perform or participate in a school

function, or participate in any other activity authorized

So it looks like that grey area where employees of the school (teachers, bus drivers, school aide, janitors) that were employeed and could/could not carry now NO LONGER can.

We had a case up here in NWI (East Chicago) where the bus driver aid (an employee of the school) had a gun on the bus. He was suspended and then fired from the job instead of being arrested for having a gun on the bus and on school property. The suspicion by many was that the DA did not want to make a test case of the greyness of the law.
