    So, blocking SCOTUS for 4/8 years would be completely unprecedented, yeah? I'm guessing it would also do even further irreparable damage to the obstructing party. I just highly doubt they could or would pull it off.

    Oh yeah, AFAIK it would be unprecedented. Heck, not executing the nomination process for the current vacancy for this long is pretty much unprecedented, too.

    You're familiar with the term "kabuki theater" in the political context, yes? There would be an element of that going on.

    POTUS can make a recess appointment to SCOTUS without Senate approval.

    Now, it is basically temporary, but depending on the timing of when the court is in session, that may be all the new POTUS would need. Plus, it pushes the issue.

    As a complicating factor, there's a recent opinion on how "recess" is construed. So, the Senate would have to play a game of are-we-in-session-or-not. Which becomes a whole different thing.

    I actually think having SCOTUS at 8 is not horrible. As political as the court has become, leave it even and embrace the political gridlock as an additional check on a politically activist court.

    When SCOTUS was resisting FDR's New Deal socialism, he threatened to get the court packed with additional justices to get the votes he needed. There's nothing constitutionally mandated about 9 justices.

The Judiciary Act of 1789 set the number at six: a chief justice and five associate justices. In 1807, Congress increased the number of justices to seven; in 1837, the number was bumped up to nine; and in 1863, it rose to 10. In 1866, Congress passed the Judicial Circuits Act, which shrank the number of justices back down to seven and prevented President Andrew Johnson from appointing anyone new to the court.     There is nothing magic about 9, true, but what goes around comes around. There will be a time when there is a more conservative president and a less conservative Senate. maybe that matters, maybe it doesn't. However I fully plan on hearing more conservative types whine about the obstructionist Senate when that happens because hypocrisy is the norm.

    Trump will be good for the 2A. I was at the last OGCA meeting and show. Donald Jr. was there standing on the show floor and addressed the crowd over the PA system. He is the real deal and a member of AR15.com. Never have I heard of a Presidential candidate or candidate's family member attending or addressing a gun show while running for the office of President. To be fair though, Rand Paul was at Knob Creek when he first ran for Senate and did some shooting on the lower range (there is video).

    Because of his sons, a Donald Trump administration would probably be the most pro-2A since Teddy Roosevelt, and certainly since JFK (who was Dem but an NRA member).

    Historically, there have been several times when Democrat controlled Senates have ratified Republican nominees, even if they fought back first.
