I also have no braces but I do have a AR pistol with a Phase 5 buffer tube. Does it qualify to be registered as an SBR with the ATF without having to pay the $200 tax?No pistol braces here...but I kinda want to go buy a few now..
If they would just say that the length of the barrel is irrelevant and all they wanted to tax was machine guns life could be much easier.Lots of unanswered questions at this point. Vague language sure does our cause no good though.
And what will this do for all of these gun manufacturers who are selling braced pistols. Ruger, Springfield and Palmetto for example. Are they going to have to put disclaimers on their guns stating that the gun is possibly an SBR depending on what optic, forward grip or magazine a person uses?
Copied from MAC's Facebook page:
In the next 48 hours the DOJ will publish a letter for a rule change on the Federal Register that will possibly change the public perception of braces and place the ATF in a position to rule on any individual braced pistol to be an illegal SBR. Things like caliber, length of pull, accessories like scopes, forward hand grips, drum magazines and bipods may lead the ATF to deem your particular firearm to be an illegal SBR. However, the letter does not offer any detailed guidance as to the specifics such as the calibers that make it a SBR, the specific length of pull, the weight, etc. it only speaks in generalities.
Because the letter does not clearly define what is a legal braced configuration vs. an illegal SBR, it leaves owners to guess for themselves what might be legal and what isn’t. Owners will have the option of registering their braced pistol on the NFA but the tax will we waived as long as the gun was in said configuration prior to the publication of the DOJ letter. You will also be able to remove the brace, surrender the gun, change the barrel length to 16” or destroy the firearm. The letter on the Federal Register will be open for comments for 2 weeks.
The end of the letter states that the rule change does not carry the force of law. So what does it mean? Only the ATF and DOJ seem to know. Welcome to the largest gun registration scheme in US history. I hope you’re as pissed off as I am. More to come.

“Every time our country stands in the path of danger, an instinct seems to summon her finest first — those who truly understand her.
When freedom shivers in the cold shadow of true peril, it’s always the patriots who first hear the call.
When loss of liberty is looming, as it is now, the siren sounds first in the hearts of freedom’s vanguard. The smoke in the air of our Concord bridges and Pearl Harbors is always smelled first by the farmers, who come from
their simple homes to find the fire, and fight, because they know that sacred stuff resides in that wooden stock and blued steel — something that gives the most common man the most uncommon of freedoms.
When ordinary hands can possess such an extraordinary instrument, that symbolizes the full measure of human dignity and liberty. That’s why those five words issue an irresistible call to us all, and we muster. So, as we set out this year to defeat the divisive forces that would take freedom away, I want to say those fighting words for everyone within the sound of my voice to hear and to heed — and especially for you, Mister Gore (edit:Biden):”
“From my cold dead hands!”
The NRA went straight in the crapper with WLP. He is a self serving douche.

Most likely if the tax is waived it will only be for "pistol" registration.
I applied for the SBR stamp a couple of weeks ago for one lower that will cover me for 2 different uppers.
If the above info is correct I will take my chances on the 8.3" barreled AR9 pistol as not as likely to be deemed an SBR.
10-4 good buddy. Loud and clear. Put the F(U) in ATF.Screw 'em. I own no braced pistols.
But. . . I will not comply.
Say it with me.
I’m a man of peace and non-violence, I don’t believe in guns.
You’re getting way too deep. I’m offended. REPORTED.jagee;[URL="tel:8535016" said:8535016[/URL]]I dont understand how someone can't "believe" in guns. They exist. To not believe in something means you don't think that thing (or things) exist in the physical world.
Very cool!!This is the Valor. CKW picked out the grips.
What say you all....?????
