My 9mm pistol can shoot off door locks. These evil black scary guns are locked in a case along with much of their ammunition. It's pathetic that a retailer has their hands tied and is being told what it can and cannot sell. They hold a FFL (Federal Firearm's License) and are allowed to sell GUNS. Anyone wishing to purchase any of their guns is subjected to a FEDERAL background check prior to the purchase being completed. I can effect more carnage with kitchen knives and a hammer than with a box of ".223 ammunition".. What if I pay a kid to steal me a hammer, screwdriver and set of kitchen knives ?? These can all go through a wall or window. If WalMart is allowed to sell toilet bowl cleaner (hydrochloric acid), hammers, screwdrivers, kitchen knives, and razor blades, surely they must be a nuisance and contributing to a dangerous community, right ? Midwest Gun Exchange has CASES of ammunition laying on the floor for someone to steal if they want, Dunham's has boxes and BOXES of ammo out in the open to steal as well.
When is the local news going to quit fearmongering and report actual factual news ??
Maybe lots of concerned legal, responsible gun owners can get together at WalMart and purchase all of their "scary black guns and ammo" so the sheep have nothing to be afraid of ??

I'm not from that area but has the local media or the council submitted any actual evidence (not anecdotal, i.e, alleged offers to pay yoots $ to steal ammunition) or reported rampant thefts of firearms and ammunition or any proof of sales to un-vetted felons without background checks from not only Walmart but other FFL retailers or have they even provided instances of door locks being shot off and LEOs being shot through their vests?
It's fairly obvious this is just more ill-informed rhetoric designed to whip the even more ill-informed into a frenzy by using the same tired mantra (that never comes to fruition) of "There will be blood flowing in the streets and mayhem" if Walmart is allowed to sell those evil things.
After all no one can drive 25 minutes south to the Plymouth store and buy all the Colt 6920s, Sig 5.56, and assorted EEVIL Shotguns. Oh wait they can. So a business that brings money to South Bend loses it to one a little further away? Gee if my face makes me mad should I cut off my nose?
I'm not a lawyer, but isn't the SB common council making rules on how WM can sell firearms a violation of IC 35-47-11.1-2 and -4(4)?
1. Does the media or common council have and actual factual evidence of the police department operating a sting operation wherein they pay youngsters to steal ammunition from Wal Mart ?
2. Has Wal Mart reported rampant thefts of firearms of ammunition ?
3. Does the Common Council have evidence that WalMart is selling firearms or ammunition to un-vetted felons without performing background checks?
4. Can the common council provide instances of door locks being shot off and LEO's being shot through their vests ?

Further, and as a last point,
By the City of South Bend (or the common council) attempting to force WalMart into an 'agreement' that they will not sell select firearms in their stores, and attempting to force WalMart to follow South Bend's 'rules' for locking up ammunition and firearms a certain way, this violates IC 35-47-11.1-2 and IC 35-47-11.1-4(4).
Section -2 reads as follows:
IC 35-47-11.1-2
Political subdivision regulation of firearms, ammunition, and firearm accessories prohibited
Sec. 2. Except as provided in section 4 of this chapter, a political subdivision may not regulate:
(1) firearms, ammunition, and firearm accessories;
(2) the ownership, possession, carrying, transportation, registration, transfer, and storage of firearms, ammunition, and firearm accessories; and
(3) commerce in and taxation of firearms, firearm ammunition, and firearm accessories.
As added by P.L.152-2011, SEC.4.
Further, section -4(4) states the following:
IC 35-47-11.1-4
Not prohibited by chapter
Sec. 4. This chapter may not be construed to prevent any of the following:
(4) The enactment or enforcement of generally applicable zoning or business ordinances that apply to firearms businesses to the same degree as other similar businesses. However, a provision of an ordinance that is designed or enforced to effectively restrict or prohibit the sale, purchase, transfer, manufacture, or display of firearms, ammunition, or firearm accessories that is otherwise lawful under the laws of this state is void. A unit (as defined in IC 36-1-2-23) may not use the unit's planning and zoning powers under IC 36-7-4 to prohibit the sale of firearms within a prescribed distance of any other type of commercial property or of school property or other educational property.
As far as I can tell, in my opinion, and I'm not a lawyer, The City of South Bend (and/or the common council) is violating the above noted laws of the State of Indiana. WalMart (legally in the State of Indiana) is allowed to sell, store, and display any firearms and/or ammunition that it deems proper based on it's own decisions as to what's best for itself.
