The officer can be dispatched, they keep the dog in the car

Well lets see........sounds like the defense could make a case for police harassment however...
Walker said he observed 25-year-old Ryan Stephens with his face about 2 inches from the rear window of the police vehicle, barking and hissing at Timber.
When Walker questioned Stephens about why he was barking at the dog, Stephens replied, "He started it. He was harassing me."
Well lets see........
This happened in front of a Bar.
The suspect smelled of alcohol.
He said the dog was harassing him.
Yup!
That gets three "Stupids" in my book.
I agree with you 100%. Stupid isn't against the law, however. If the dog is so volatile that it is considered harassment to mockingly bark at it why didn't the officer inform that man as such and give him the chance to leave?

So he violated the "UncleMike's Three Stupid's" law?
Can you cite that statute?

Three "stupids" almost always earns someone a trip before the Judge.
Looks to me like the guy is going to end up a Darwin Award Winner some day.
I think NYfelon would advise against that.
