    Many on this thread have said it but it's worth saying again and again;

    All weapons are always loaded, all the time.

    I know that's kind of simplistic and not really the true essence of what you were asking though. So, IMO, if a loaded mag is inserted, a pistol is loaded. For revolvers, a cartridge in the cylinder constitutes loaded status.

    If they think it's NOT loaded then they can keep it pointed at their self. If it's pointed in my direction I'm going to consider it loaded and take appropriate action.

    This is like a quantum physics question. The Heisenberg Uncertainty Principle. Is the gun loaded or unloaded? Or is it loaded or unloaded only because you observed it as such? Otherwise the gun is described as both loaded and unloaded simultaneously.
