    I had a client I was representing on the civil side and a friend was doing the criminal defense. My friend worked out a good deal for 48 months on 22 counts of federal healthcare fraud with an alleged fraud amount of into the millions. The judge rejected the plea. My client then "fired" my friend and ended up with 84 months on a subsequent plea deal. Judges, especially in federal court, don't rubber stamp the plea agreements.

    Have to do 85% of the time, but there are credits given for some things like completing a substance abuse program assuming that you can convince the BOP that you have a substance problem. Also, some of the time can be in a half-way house.

    There is no early release in BOP for a sex offender AKA Walsh act. The only cases where BOP releases or can reduce inmates sentence is the completion of certian drug courses and even that is santioned through the courts. In fact in certian cases BOP can maintain custody of sex offenders after their sentence. in Fogels case he will probably be released to a halfway house at his 85% mark Unless he gets a sentence reduction through court however again not likely due to not only a a sex offense but a sex offense with minors and other factors.
