All depends on when it was said to the judge, and what was actually written on the "official piece of paper" Also a prosecutor does not have to fill all the charges. A Jury can convict on a lesser charge even if it is not requested by the prosecutor, or at least that is the way it was explained to me. Although I am not sure the same holds true in other states.
