So, even worse news about my accident. Bike is a total loss, although I guess I could still probably fix it if there's no frame damage. But I'd have to pay for it myself, her insurance company has basically denied the claim because they can't get ahold of her to get her statement. Like a police report placing 100% fault on her and a witness isn't enough...
I want to fight them but I don't know what I can do. We've been f*#$ed out of too much money recently to just drop this and let it go. (one example, we had a contractor take the deposit we gave him for home improvements and run off with it, he was even charged with a crime as well as the lawsuit we filed. He's still in the wind..)
This is no reason to deny your claim. They are forcing you to get an attorney and I would do it.
At least talk to one about this.
My husband had someone pull out in front of him last summer on his bike. He laid his bike down to avoid hitting their car, and they took off. Witnesses saw the accident. One chased the car but was unable to keep up with them or get a plate number.
I'm not saying it was right for the car to take off... but my understanding is if a driver isn't involved in a collision they can't be at fault for an accident. Had the person stopped and exchanged information I don't think your insurance company would have been able to get any kind of payout from their insurance because there wasn't collision between the two vehicles. I'm not even sure the police could have issued a citation.

There were multiple witnesses that saw the guy fail to stop for the stop sign. He was on a side road heading west and my husband was on the highway heading north. The guy stopped when his front bumper was on the centerline of the highway in front of my husband. There was no disputing that the accident was caused by the other driver. He caused the accident and then fled the scene.

People do it all the time. Its a really big thing with Goldwing riders. I tell them every time I put one on that I don't recommend it and make them sign a waver. But they swear they don't have any trouble out of it. I just don't trust putting that much lateral pressure on a tire that wasn't designed to ride on the edge.

Running a stop sign might make it more clear legally. I have no doubt that in your case the accident was caused by the fleeing driver... I just wasn't sure of the legality of it. The example I was basing my comment on was something like: Driver A swerves, Driver B swerves to avoid driver A, but hits Driver C. The accident is between driver B & C. Is Driver A "involved"? Liable?

We're all done too. Took them out Thursday to enjoy the gift of 70 degree weather in November. Already had them detailed and the brake/clutch fluid changed out, so I just changed their oil when we got back, wiped 'em down, and tucked them in the shed for the winter...
