You never know where something like this would lead. It was the guy carrying on his own property that got arrested in Milwaukee, WI that led to the court decision that open carry in Wisconsin was legal (CC is not). The Milwaukee mayor had a hissy and instructed his officers to deal with people carrying severely and has been warned by the courts that the common disorderly conduct charge will not be tolerated.
Actually, it was the police chief that ordered his people to assault gun owners and steal their property. It's not just the politicians, it's their Liberty Eradication Officers.

ome law enforcement officials are preparing to face more open-carry situations, and some are clear the memo won’t change their approach.
Milwaukee Police Chief Ed Flynn said he’ll continue to tell officers they can’t assume people are carrying guns legally in a city that has seen nearly 200 homicides in the past two years.
“My message to my troops is if you see anybody carrying a gun on the streets of Milwaukee, we’ll put them on the ground, take the gun away and then decide whether you have a right to carry it,” Flynn said. “Maybe I’ll end up with a protest of cowboys. In the meantime, I’ve got serious offenders with access to handguns. It’s irresponsible to send a message to them that if they just carry it openly no one can bother them.”
Troops. Shows where his head's at.

If it turns out that Mr. Noble did not have a valid permit, then he should be arrested.

FACTUALLY, he did not need a permit to open carry his firearm in PA. Their laws are more freedom oriented than here in that respect.

Of course, Jack has since been acquitted.

Does anyone know the outcomes of this? I can't seem to find anything on it in the news or the PA gun forums mentioned... :dunno:

If it turns out that Mr. Noble did not have a valid permit, then he should be arrested.
(as noted earlier no permit is needed for Open Carry in PA, excpet in Philly which he wasn't in)

Honestly, permits and licenses for exercising our Rights are violations of our Rights. No idiotic law to the contrary should be tollerated.

The idea that "the law is the law" would be a great one if people first applied the HIGHER LAW.

As to Indiana the RKBA is clearly defined in both the US and State Constitutions. The law requiring a LTCH to first excerise that Right is, by default, invalid.

"Certainly all those who have framed written Constitutions contemplate them as forming the fundamental and paramount law of the nation, and consequently the theory of every such government must be that an act of the Legislature repugnant to the Constitution is void. -Marbury v Madison 1803"

Anyone who has taken an oath to uphold and defend the Constitution and harrasses or arrests a person based solely on lack of a license/permit to carry a firearm is violating their oath and is, by definition, a traitor. Liek wise so are the legislatures who made it illegal.

There is no way to sugar coat it. There is no way to justify the violation of that oath.

The USSC could rule the opposit tomorrow, it wouldn't change what the Consitution is or what it says or the oaths taken.

"Thus, the particular phraseology of the constitution of the United States confirms and strengthens the principle, supposed to be essential to all written constitutions, that a law repugnant to the constitution is void, and that courts, as well as other departments, are bound by that instrument. "

Yes, other departments would also be police departments as well. The idea of "following orders" falls on it's face because the supreme orders are what the oath was sworn to... The Constitution.

I'm still at work and going on 20 hours... please excuse any type'os, lol.
