    Yeah, my sons class cancelled a trip there because of this. I offered to go with them but they didn't bite. So, who is up for a trail ride/walk this weekend?

    What if the kids showed up and you happened to be there fishing, eating lunch, jogging or whatever?
    I don't think anybody can answer that conclusively because there hasn't been a test case. It might depend on where in the park you are and where the "school group" is. Are they across the park or do they plop down next to you and start fishing?

    What if a school bus full of school athletes and cheerleaders stops at the McDonalds i'm at, do I have to run for the hills? Does the McDonalds now become a defacto school function?

    Outside of that, I haven't seen anything to indicate that a field trip to a public place constitutes a school even and therefore the property would be off limits to firearms.

    Exemptions from chapter
    Sec. 1. This chapter does not apply to the following:
    (1) A:
    (A) federal;
    (B) state; or
    (C) local;
    law enforcement officer.
    (2) A person who has been employed or authorized by:
    (A) a school; or
    (B) another person who owns or operates property being used by a school for a school function;
    to act as a security guard, perform or participate in a school function, or participate in any other activity authorized by a school.
    (3) A person who:
    (A) may legally possess a firearm; and
    (B) possesses the firearm in a motor vehicle that is being operated by the person to transport another person to or from a school or a school function.

    There is no case law, but the way the law reads if you are eating at Wendys and a bus pulls up, you are in trouble.

    With respect to the park question, the property isn't being used for a school function, only part of it is. But who knows what the police and prosecutor there would do, and whether the court would agree with them or not.

    Another reason to pay attention to judicial elections locally, and judicial retention statewide.

    Wendys could be for lunch or learn how to say "do you want fries with that" & the law doesn't say anything about parts of places.

    THERE IS NO CASE LAW. so who knows what would happen.:dunno:

    So, what keeps us all from writing Indy and telling them to amend this to be more clear? In our favor, of course.

    That could also be construed to say if a school bus is on the same road you are on, you better not have a gun with you. It also isn't clear about what happens if the school bus is being contracted for a non-school function, like the shuttles at the free event held at Fort Harrison last month.

    I would say that unless the class is on a field trip to Wendy's it isn't a school function. But, if you are at the park and a class comes out, that could be an issue for a stupid DA that can't find anything better to do.
