    I was on a jury once where three witnesses picked out the same guy. They described a young black man wearing a stocking hat and sunglasses to the police. After they arrested the guy they all picked him out of a police lineup. The judge threw out the case when it was revealed during the trial that none of the witnesses could identify the guy until they put a hat and sunglasses on him. I think the cops really wanted it to be him for some reason.

    Three witnesses who were shown the photo fingered Starks, though two expressed doubts while doing so. The third witness who picked Starks was a 10-year-old child."I'm not sure, but he sorta looked like number four," said one witness, according to a transcript. "I'm not sure, but he's the closest."

    If the above is true, he was not picked out of a lineup. Two maybes and a 10 year old do not "picked out of a lineup" make.

    I would be really curious to see what the PCA said about the lineups vs the tapes/transcripts.

    Nope. And then she used an old book in photo of him in a red shirt too? Geez.

    Wow, the 10 Pointers decided that a case where the actual suspect is black and the arresting officer is black is one to cry prejudice against blacks on?

    It's not odd at all. You'd be surprised at all the grief black officers get.

    Not odd at all. Eyewitnesses are actually wrong a lot about everything.

    Last week, state's star snitch identified an investigator with the Prosecuting Attorney's office as the defendant. It may have been why they had such trouble with the case.:D

    I had the privilege of being a star witness on a stupid case against a drunkard in California some years ago. When the defense asked me how I could positively ID him after 13 months I said "he was pretty funny lookin'" ala Fargo. Not only was it true, but the prosecutor, defense lawyer, and the entire jury chuckled when I said it.

    In my defense he was realllllly weird looking. I ran into him a year or so later at a gym. He was not happy with me.
