I know the law has changed on the carry of firearms in State Parks but what about City Parks? I often bike, kayak and hike in Eagle Creek. I also frequent the Monon Trail. I'm wondering about the laws covering these areas and other "city" land. [Military Park, The Canal...etc]

    Where's the bacon?

Cities currently have the power to restrict firearms carry on lands and in buildings they own or administer, excepting public highways. In short, yes, they can, and if I remember correctly, Eagle Creek is marked as such, with any shooting done there done on a range that is "cold" (where you load only at the line)

    Hope that helps!

    Blessings,
    B

The Eagle Creek range is seperated from the park except for the dog park.

Indianapolis city parks are off limits by virtue of a city ordinance. In the research I have done, most larger Indiana cities have such an ordinance.

What is the penalty if prosecuted for carry in those locations? If I understand correctly, local laws cannot go past the misdemeanor level, correct?

    AFAIK, IANAL, etc.

It is an infraction (like a traffic ticket), please let me know if this is not correct.

This ban also applies to the linear parks (Monon Trail, etc.), correct?

The way I see it is no one should know I'm carrying unless I need it. At that point, even if I get the infraction, it is better than beaten or killed. Not that I would advocate breaking stupid and unjust laws.

I didn't make an exhaustive search but this is all I found:

Sec. 103-3. General penalties for violations of Code.
    (a) Whenever in any chapter, article, division or section of this Code, or of any ordinances amendatory thereof or supplemental thereto, the doing of any act, or the omission to do any act or to perform any duty, is declared to be a violation of this Code, or of any such amendatory or supplemental ordinance, or of any provision thereof, or is declared to be unlawful, and if there shall be no fine or penalty otherwise specifically prescribed or declared for any such violation, or for doing or for omitting to do any such act or to perform any such duty, any person who shall be convicted of any such violation, or of doing or of omitting to do any such act or to perform any such duty shall be fined, by way of a penalty therefor, not more than two thousand five hundred dollars ($2,500.00) for each such violation, act or omission.

    (b) In addition to the foregoing penalty, the city may enjoin or abate any violation of this Code by appropriate action.

If it's owned or administered by Indy Parks (Monon trail is) it's off limits.

Its really sad that the parks are off limits, there are more scumbags and trouble makers hanging out in Broad Ripple park everyday. I admit I carry in the park even though I'm not supposed to. I live next to the park and want to enjoy the things my taxes pay for. Its my right to protect my family.

I thought I read in another post, that the victim zone also includes any water ways that are used by the Indianapolis Water Company. <start edit> It is actually a reservoir or property owned by the Indianapolis Water Works.<end edit>

I thought this was a very odd clause because isn't the Water Company a private company in Indy? This would be like having a city ordinance saying that you can't carry in a department store?

I will see if I can find the MC law.

If you all are really bothered by this I would suggest putting ink to paper and letting the proper people know about it. Here is a INGO member looking to do something about it. Could use all our help.

    Nothing on Wabash, eh? Good!

    Josh <><

Wabash has an ordinance that doesn't allow concealed carry.
I just briefed it so I don't know if it contains an out for LTCH Holders.

Just found out that South Bend has an Ordinance against "Assault Weapons"
Looks like it is still recent. Does anyone from South Bend on this forum know about this?

From the recent "events" on the Monon Trail, it appears that this is one of the areas where licensed carry should be allowed. I see that the muggers along the Trail don't seem to be following the law. Oh yeah, they are criminals. Just like I would be if I attempted to defend myself against them.

That way the police will ave a good picture of the masked and or hooded mugger.

That is if the cameras continue work unlike the call boxes.....

The good side is they can call the ambulance sooner.
